1. Agreement
By installing or using Askably ("the App"), you agree to these Terms of Service. The App is provided by Neovex Pty Ltd ("we", "us"). If you do not agree, do not install or use the App.
2. Description of service
Askably provides an AI-powered customer support chatbot that integrates with your Shopify store. The App syncs your product catalog and store content to answer customer questions automatically via a chat widget embedded on your storefront.
3. Account and access
You must have a valid Shopify store to use the App. By installing, you authorize us to access the Shopify data specified in our API scopes (products, content, orders, themes) as described in our Privacy Policy. You are responsible for maintaining the security of your Shopify account.
4. Pricing and billing
- The App offers Free, Pro ($49/month), and Business ($99/month) plans
- All billing is processed through Shopify's billing system
- Conversations exceeding your plan's monthly limit are billed at $0.05 per conversation
- You may upgrade or downgrade your plan at any time through the App settings
- Refunds follow Shopify's standard refund policies
5. AI-generated content
Responses generated by the AI chatbot are based on your store's data but may occasionally contain inaccuracies. You are responsible for reviewing and correcting chatbot responses through the knowledge editor. We do not guarantee the accuracy of AI-generated responses and are not liable for decisions made based on them.
6. Acceptable use
You agree not to:
- Use the App to distribute harmful, illegal, or misleading content
- Attempt to reverse-engineer, interfere with, or abuse the App's infrastructure
- Exceed rate limits or use automated tools to generate artificial conversations
- Use the App in violation of Shopify's terms of service
7. Availability and support
We aim to maintain high availability but do not guarantee uninterrupted service. Planned maintenance will be communicated in advance when possible. Support is available via email at [email protected] with a target response time of 24 hours on business days.
8. Data and privacy
Our collection and use of data is described in our Privacy Policy, which forms part of these Terms.
9. Limitation of liability
To the maximum extent permitted by law, we are not liable for indirect, incidental, or consequential damages arising from your use of the App, including lost revenue from chatbot responses, service interruptions, or data loss. Our total liability is limited to the amount you paid for the App in the 12 months preceding the claim.
10. Termination
You may stop using the App at any time by uninstalling it from your Shopify store. We reserve the right to suspend or terminate access for violations of these Terms. Upon termination, your data will be deleted within 30 days as described in our Privacy Policy.
11. Changes
We may update these Terms from time to time. Material changes will be communicated through the Askably dashboard. Continued use after changes constitutes acceptance.
12. Governing law
These Terms are governed by the laws of New South Wales, Australia.
